Overview

Forming a company does not protect your brand

Registering an LLC gives you an entity name on a state register. It does not stop anyone else in the United States using your brand name, and it will not help you take down a copycat listing on Amazon or a hijacked social handle.

A federal trademark does. It gives you nationwide rights in your class, access to brand-protection programmes on major marketplaces, and a real basis for enforcement.

The order matters: search first. Filing an application for a name that is already taken means losing the government fee, which is non-refundable, and starting again.

Do I need a U.S. company to file?

No, foreign applicants can file. However, foreign-domiciled applicants must be represented by a U.S.-licensed attorney at the USPTO — we coordinate that where it applies.

How long does registration take?

The USPTO process runs in months, not weeks, and the timeline is entirely theirs. We will give you the current realistic range rather than a marketing figure.

What if my application is refused?

Office actions are common and often answerable. We help you respond. Government filing fees are not refundable if a mark is ultimately refused, which is why the search comes first.

Is the search a guarantee?
